B.C. doctor's appeal over right to pay for private health care dismissed by Supreme Court of Canada

Canada’s highest court will notĀ hear an appeal from a Vancouver-based physician who has been challenging theĀ health-care system over the right to access private care.Ā 

The Supreme Court of Canada’s decision Thursday ends Dr. Brian Day’s 14-year legal battle to allow patients access to private care when the public system isn’t able to offer timely care.

Day,Ā owner of the Cambie Surgery Centre inĀ Vancouver,Ā claimedĀ that prolonged wait times for medical procedures violated two Charter rights, including the rightĀ to life, liberty and security of the person.Ā 

ā€œIn a way, it’s a very sad day for Canadians,ā€ Day told CBC News after the decision was released Thursday
